I just bought a dvd in the store that was shot with a XL-1 and other minidv cameras. Black Bike Week in Myrtle Beach, SC is the flick. Anyway, when it first comes on, there is a Copyright disclaimer on the screen. For the most part the music they used is mainly their own stuff. However, there are many parts of the video where you can hear copyrighted music being played out of car speakers, or outside dj's, etc. Now this was an indirect use of the music meaning that the camera operator just happened to filming some bikes and was picking up the music off camera. In the credits, they only listed the songs that they produced. The copyrighted music was not listed at all. Isn't that illegal? I thought you could use copyrighted music if you are NOT going to sell the product. Let me clarify that they werent using the music as a part of their soundtrack. It just was playing in the background from loud speakers as they walked around the Bike Show.
I am working on a similiar project and I have the same sort of thing going on where I am in a public place getting shots of cars but there is copyrighted music playing over the loud speakers. How do I get around it? Example, they had a talent show at the event I was shooting and a few people were singing and dancing to copyrighted music that you would hear on the radio. I can't use none of that performance huh if I plan to sell my dvd?
I think I need to sit down with a copyright lawyer soon!
