copyright question

I want to use a popular song in a clip...If I play all the instuments and sing it myself, what's the deal....Still copyright violation?

yup, you would never be able to legally distribute it without obtaining the proper permission from the right's holder..

Play all the instruments and sing it yourself? Hmmm It's a copyright violation and a disturbing the peace violation. :) hehehehehehe Sorry Mino, but you know someone was going to say it. Might as well come from a friend.

If you can change the song, and make it your own, that might be your way around it. Good luck!

Good queston. Clubs use copyrighted music and now they must pay a yearly fee to use the music. I'm sure coverbands will soon be paying the same fees.

I just remembered years ago I went out with the lead singer of a band in Toronto seems to me they had to pay some sort of house fees maybe for playing other peoples material? maybe the house had to pay out? We ended up splitting up because I couldn't handle her wearing mini skirts and no underwear...I mean, the band was UP on stage and you could clearly see her meowser. I was told that I was wrong about the whole thing...Ijust didn't understand the entertainment industry. The madness of my youth!

Mino, just redo the song! Who cares! You're not making any kind of money off of it right? If you're just doing this for experience or for your reel then go for it. People uses copyright material every single freakin day and I haven't seen one person get in trouble. Or you can Puff Daddy. :)

Oh I can see it now

Judge: " and just who told you it was ok to use this material?"

Mino: " Oh I don't know your Honor....Green cow...Purple antelope....Red cat....Ummm"

Judge: " You are about three colored animals away from a jail sentance Mr. Mino Tell me..."

Mino: " Bluespider yor Honor sir, yes it was a blue spider that told me it was ok!"

Needless to say Mr. Blue lawyer I need to dig a little more on this one!

There are many layers of copyright protection, but in the instance you described (you re-do the song, and you play the instruments and sing yourself) then you eliminate perhaps the most costly layer... the original artist's performance. That's where the big bucks usually go, and why you'll hear "cover bands" doing Beatles tunes in commercials, etc.

So in your instance, you still need permission from the music/lyrics author (i.e., whoever wrote the song). That may or may not be the original artist. But yes, their song and their sheet music is copyrighted, and if you want to use their material, you need their permission.

Performance rights and sync rights are two different animals.

An artist gets paid for each performance of their tune... well -- not the artist the owner -- usually some overpaid lawyer who scammed the artist out of their due.

Anyway -- the performer is responsible for the fees, but if they play in a house that pays a yearly fee to ASCAP or BMI or SECAM then all is good. If that house pays for piped in music then you should be fine ... as a cover band.

NOW -- sync rights. That's another story. An artist can say NO to you using their material. Once you put something on video it goes to another set of lawyers. UGH.

Stay away -- runs into 10s of 1000s!!!

Meowser -- never heard that one... VERY funny!!!!

I had to come up with a word for word and meowser seemed to fit the bill I mean you just can't come out and say Pussy can you!

If you use your own version, you don't have to pay the mechinical sync fee, but there is a fee due to the publisher (or songwriter) for the usage.

Cool....Thanks! Do you have any idea on the cost percentage vs copyrighted recording by actual band...If that makes sense
