Can I use a quote from Anne Frank?

If I was going to make a movie (not about Anne Frank) but was to use a quote from her diary to set the tone, could I?

Would that fall under fair use or public domain?

Thanks,

Mike

It's not going to be in the public domain yet (at least, translations won't be).

I believe that the rights are held by the Anne Frank Foundation: http://www.annefrank.ch/

You could contact them and see what their policy might be.

You can probably use the quote without worry, though, if it's a relatively short excerpt. We used a paragraph from Meine Kampf on a project some years back and there weren't any issues (although we started with the original German and we obtained our own translation from a native German speaker).

Thanks. Just sent them an email.
Hopefully they'll get back soon.

Fair use only covers, news reporting, scholarly research, or critical review, some other non-commercial uses. U.S. copyright expiration is (for most cases) 95 years after death. You need permission.

They got back to me. They want to see which quote it is but they said in the email that since it's just a quote it should fall under fair use. I'm sending it off to them today for final approval.

I found it ironic that the use of a quote from Meine Kampf was used as an
example in response to a question about using a quote by Anne Frank.
