Camera Rental

Some people want to rent my HD camera. What are ways to protect myself if equipment is damaged?

Slide a credit card for the amount of the equipment? How do I do that?

Cash deposit? (probably unlikely)

Insurance? any suggestions?

Other options?

Why dont you charge for your services as the DP instead? Your camera is in the best hands when it's in your own hands...

Hi David,

I thought your site design was novel. Be sure to get your T&Cs, disclaimer, privacy statments, etc, all up and running ASAP. You appear to be providing a brokerage-based advertising supported hosting service to third parties. If so, be sure to say how you and others fit in the value proposition.

Even more importantly, be sure to get some legal guidance on several critical areas. If fraud is involved, what responsibilities do you assume? (certainly you'd be named as a third party if the injured party cannot seek redress from the defraudulent party). Even worse, what if something terrible happens such as someone getting electrocuted when the rented equipment has a ground bypass, etc? I don't see any recitals on your site at all addressing personal loss liability.

For instance, even though I simply have an online bridge instruction website that has nowhere near the exposure of an equipment rental biz, I've taken every opportunity to mitigate liability and privacy concerns - see:

http://www.bridgehands.com/Admin/BridgeHands_Disclaimer.htm
http://www.bridgehands.com/Admin/index.htm

Be sure to consider factors including such as your GoDaddy webhost, California jurisdiction, etc. Hopefully this is all work in progress for you and you'll address these critical issues immediately. Additionally, on your website you'll want to explain everyone's biz relationships to prospective clients.

Good luck, Michael

Well the first thing you have to ask yourself is, did you buy this camera to go into the rental business?
If you did then you should definitely be set up to take credit card payments and explain to the client that you will be putting a holding deposit of the value of the equipment on their card until it is returned in working order. If they dont have enough credit to be able to do that then they should supply you with a certificate of insurance from a reputable company naming you as the loss payee should something happen to your equipment.
Personally I dont rent my equipment out unless I am on the job in some capacity as it is not worth the aggravation and possible loss of work should my camera be returned in unusable condition.

Hi Michael, thanks for the post! I am in the process of all that, the Privacy Policy is up currently and more to follow. Cheers, David

Rehi David,

Good job getting your privacy policy in place. While I was out walking the dog tonight I got thinking your GoDaddy host probably had a hosting policy similar to my Yahoo Merchant account. Sure enough, below are your GoDaddy T&Cs that you should ensure your customers also follow - you'll need to actively police your site or GoDaddy could shut you down, which they did without notice to another customer 2 weeks ago.

But as was previously mentioned, keep your main focus on your legal liabilities (and associated disclaimers, insurance, contracts and biz policies) as well as a clear description of roles/responsibilities/processes/etc spelling out the big picture of various business transactions.

Regards, Michael
