Business Advice Needed

Hello, I'm new here, and this is my first post. I'm hoping to pick up some advice.

I've made 6 special interest DVD over the last few years, and I've been fortunate that they have sold pretty well. With each of these DVDs I've had an agreement with the demonstrator that we would each get a master copy and sell the individual DVDs however each of us wanted to. This has worked out OK, but I'm ready to expand the business and get more professional with it.

The DVDs that I've already made have been with local demonstrators who are friends of mine. However, I'm now starting to get the opportunity to film videos featuring demonstrators who are professional and are know nationally. Because of this I believe it's important to get more formal in my operations. This brings me to my questions...

1) I will either be paying the demonstrator a percent of each video sold or a set price per DVD. Which method works out better? Some of my DVDs are sold to resellers at a discounted rate, so the percent would be a percent after the discount for those.

2) If I got with a percent, is there an industry standard or guideline for what to pay the demonstrator? 20%, 30%, 40%, or something?

3) I know I need to create some type of agreement or contract between me and the demonstrator. How do I go about this? Some of the things I want in the agreement are the fee that the demonstrator will receive, and who owns the video rights. What other important things should be included? Does anyone have an example of an agreement that I can look at?

4) If I'm paying the demonstrator per DVD sold, how long do I go on doing this? I would hope not forever, but I guess I would need to set a time limit in the agreement. Is there a standard? 10 Years? 20 Years? The nice thing about these DVDs is that I'm still selling the videos that I made 8 years ago.

I love making these videos, and I'm excited about adding to my collection. However, I'm pretty stressed about how to approach it from the business side.

Any help will be much appreciated!

I would suggest a buyout for the presenter assuming he will agree to it and the price is right.

Percentage deals can get very complicated and I would advise legal advise on how to set it up and a CPA to handle the books.

Thanks for the advice, Paul.

What's the best way to approach a buy out?

If pay the demonstrator a percent, what is an acceptable percent that's fair to both the demonstrator and my company?
