Ok so I been keeping my cool long enough.

I've worked with them for a while this would have been my 3rd time. But this time they didn't pay me on the spot so I have to tell you it's been 3 months since I been paid. since then I haven't been able to pay rent, and I was in a car wreck which would have help with payments and so on.

3 MONTHS AND HAVEN'T BEEN PAID!!!!

THEY JUST GIVE YOU A BUNCH OF BS SAYING THE CHECK HAS BEEN CUT AND SENT EVERY DAMN WEEK.

OK and you think thats bad... IT'S HAPPEN TO PEOPLE I KNOW AS WELL:
MICHAEL MCQUEEN AND ANTHONY GREGORY, both dvxusers.

Both these guys have families and bills and when they don't get paid it hurts.

so this company doesn't pay for what they get so don't work for them..

JOBS DYALECT DO FOR TELEVISION

STOMP THE YARD
STOMP THE YARD: SUPER STOMP

they are located in NY but have worked in NC and across this nation. so beware people.

All I want to do is get paid.

dont hand over the media till they pay.....

Unfortunatly it rarely works like that. I work with a production company and while I don't have to worry about the finances I know that most of our clients work on a net 30, so we don't get paid until 30 days after the product is delivered.
The best thing to do is get the word out, much like spidey is doing, if a company doesn't pay people need to know about it.

go down to their office and demand they cut you a check right then and there.
if they give you some excuse about the the checks in the mail, tell them they need to put a stop payment on it and give you another one. it's been three months and you're done putting up with their bs.

I shoot the stuff they put on espn. ans scharky is right they siad 14 maybe 30 days which I used to but this is pissing me off. nearly 90 days. Im about to contact the the better business beauru and then get lawyers involved you....

the only way to make someone deal is when you deface them. i got mangler defacing them elsewhere. deface them and less likely they will have jobs them self....

okay i see now. that does make things more difficult. good luck with everything.

I work in a mid sized market with a bunch of mid sized production companies. We have one huge facility that provides a great deal of the work for the freelancers. They have a reputation of paying 90 days out, sometimes even longer. The facility can do whatever they want because they are the biggest show in town. Many of the freelancers no longer do work for this company because their business tactics. One of the freelancers that refused to work for said company was a very talented motion designer. The company soon realized that this individual was an integral part of the company. Anyway they kept asking him to come back to which he steadfastly refused, he had bills to pay now not 90 days later. Eventually he drew up a simple agreement, the terms stated that the company would pay in no more than 30 days. They signed the agreement, he's done work for them since and received payment on time.

Another strategy for future projects is to inflate your day rate and discount for prompt payment. For example: if your day rate is $500 double it to $1000 and clearly mark up the discounts on your original invoice.
Ex:
Net 30 days 50% discount - $500
Net 60 days 25% discount - $750
Net 90 days no discount - $1000

Oftentimes you want to throw a 'penalty' on the invoice for late payment. Penalty is such a harsh word, nobody wants to pay a penalty. Discount is good word. It sounds like you're getting a deal. Everbody wants a discount.

We use a discount incentive system as well. Effectively, if the client pays as set forth in the Terms and Conditions of our agreement, they enjoy discounts as indicated in the proposal (estimate). If they pay later than the end of the discount period, they pay full fare.

Oh, don't ever discount labor though. Not even if you're working at a diminished rate - simply show this as a different rate tier. Don't ever, ever discount labor.

Unfortunately, even our best proco clients need reminders for payment. 90 days definitely represents the outside. We invoice each week, so the client is billed once the job is complete or, on longer, sustained mandates, at regular intervals as negotiated in advance. Subsequent to the original invoice, a statement goes out exactly 31 calendar days after the invoice and a second statement at day 61. Collections and suspension of account after 90 days. Unfortunately, broadcast nets often release funds to the proco once the show delivers, so there can be a real gap between your contract services and when the proco actually has the money to pay you.

More savvy, responsible procos will pay their labor details against an early advance or have cash-on-hand to alleviate situations like Spidey's. Good luck and remember to keep it professional no matter how dirty it gets.

its been a real pain trying to deal with this company. like jeremy(spidey) said, they usually pay on the spot, but this last gig they said to invoice them. i worked a different shoot than jeremy did, 2 days before his shoot so it has been even longer since they've paid me. i've left messages for accounts payable and of course no call backs cause they deal with a 3rd party accounting firm. which i didn't find out till recently. so everyone be weary of working with dyalect marketing/stomping on the yard productions. they were doing some stomping events for boost mobile. who's theme is "where you at?" so dyalect marketing, where you at with my check?
