A different kind of film financing question

At least I think it is. I'm looking at the different ways to finance a feature film and I want to see if I have the facts straight.

Production Loans - Good source of funding, but often (always?) require a distribution deal be in place, which often (always?) requires name talent be attached to the project.

Passive investors - Asking rich people for money. Great if you know some people with money. My issue is that it seems to an SEC violation to pursue passive investors without a security offering, which is pretty expensive to set up properly (improperly is as bad as not setting one up at all, maybe worse).

Active investors - Getting money from people actively involved with the project (or personal friends of someone actively involved in the production of the film) i.e. Someone with an Exec. Producer credit. Problem here is that the person has to be involved in more that just the raising of funds; they have to be an active participant in making decisions regarding the film.

Personal Funds - Obvious problem is not being independently wealthy

What have I missed? Is there anything that I have misunderstood? I'm not asking where to find money, but rather what are the LEGAL ways to go about raising money. I've consulted a lawyer about these questions, but I'm hoping to get some additional insight from people with first hand experience.

I think you pretty much said it all, don't know how good your credit is, but the best bet would be to go to your local bank and ask for a personal loan. Don't know how big of a budget you're trying to get, but you can make a decent film off a nice little personal loan from a bank.

That's what I did on my current project, I set up direct deposit so that way I'm paying off the loan as I'm making the movie...

If that's not an option for you, then eat ramon noodles for 6 month and save save save...

But I know the best thing you would rather do is just get an investor to just say hey, here, take 40million of my money and make ur movie, but in reality that chance is slimmer than nicole richie in a bathing suite, not saying it doesn't happen, but if you wait around for it, ur movie will never be made.

Do the old beg and borrow thing... I left out steal... unless you want to do your post in jail or your doing a prison movie... do they allow cameras and lab tops in a cell... : )

This might take as much time as finding investors... in a way it is... finding investors… but see what your friends and family can bring to the table... maybe Uncle Charlie won't be a prick and he'll loan you his Corvette (of course use common sense here and don't use it in a demolition debry) or Aunt Sally and Ruth will cater for a week... while your mom and her friends will cater the other week...

Team up with like minded people... that is the hard part... it takes time to learn who is real and who just talks about making movies... or they have the same vision as you… for example I like writing with a partner now… someone to feed ideas off of and to get ideas that I never thought of… but it took me three writing partners to find the right one…

Maybe your boss will let you shoot in his high class restaurant at night for free and do catering... just examples I'm throwing out...

Look Robert Rodriquez in his book Rebel Without A Crew talks about his friend’s uncle or basically had a bar and ranch in Mexico... so guess what he wrote a script around a bar and ranch in Mexico and the rest is history...

A couple of other things left out...

Pre-selling DVD's of your movie. A hard thing to do, but I think it has been done with varying degrees of success.

You might also try to think of creative ways to get people to just GIVE you money to make your movie. Not a loan, not an investment -- an outright gift that does not need to be repaid. I've seen folks who setup websites asking for donations to make their movie. Or people belonging to a specific special interest group might want to support a film project that endorses their particular cause -- animal rights, pro-life, or whatever.

You could let your fellow filmmakers help. Organize a film festival which showcases the work of indie filmmakers, and use the proceeds to help make your movie.

Then there's always the car wash/bake sale/yard sale approach. :-)
