3 Distribution Choices and I'm Lost. HELP?

I'm going to be taking a two week break for Christmas and New Years. Upon returning to LA next year I'll be making a decision regarding distribution to which I'd really appreciate any advice or knowledge this community could offer.

The film "Fathoms Deep" http://www.dvxuser.com/V6/showthread.php?212004-Fathoms-deep is my first feature and I'm afraid I have no experience at all with distribution. On the plus side, we've garnered a bit of positive press for the film and word does seem to be spreading. I've also been approached by 3 distribution companies who each have their own ideas about getting the film out and making sales. On the negative side, distribution appears to require much more transcoding work on my part or money in the $5,000 range to have someone transcode to worldwide platforms.

I'll outline the 3 deals while keeping the company names out. If you're interested in knowing them you can PM me.

Deal 1 - The Proclaimed "Best Deal In Town" - I sign a non-exclusive deal with this company and they put the film on itunes, Video On Demand, Vudu and maybe one other platform and take only 20% of the sales. However they do ZERO marketing for the film so I have to draw sales. This is a small but known distribution company

Deal 2 - I pay $5,000 for internations and cross-platform transcoding and this company will put the movie all over the globe at once. Saturating every market. I retain ownership of the film but split the revenue with them 50% They will also target one US city to run a theatrical release and if it goes well we'd continue the theatrical campaign before releasing the film to the internet. I think there will be additional marketing costs required of me to Theatrically run the film. This is an unknown distribution company with only a handful of films under their belt. However talking with the agent, I did get a great vibe from them.

Deal 3 - Pay a retainer of $15,000 for a sales rep to get marketing and international sales. - This is a known distribution company. Exclusive Contract.

I've already got a website up selling dvd's and a streaming version of the film. Help with any advice. I want to make a decision early in 2012 so I can move on to my other projects and not worry about my first film any longer. Does anyone have a recommendation I don't know about? I was hoping to get better offers or at least a clear obvious choice but most of the distribution companies wouldn't take the movie without name talent so it looks like these are my choices.

Thanks,

Providing a master is one thing.... but I wouldn't pay any sales agent up front... check out Mark Litwak... some don't like him because he puts out a newsletter on who pays and who doesn't ....

Check out Epic also...

What exactly does this involve?

It concerns me that in each option you are paying the provider...surely they should be working for you? And investing in the outcome?

Yeah, Z, I smell something fishy too about having to pay up front. It reminds me of book deals. If you have to pay for the publishing, then they aren't actually distributing your book.

Now if they asked for something on the back end or percentage, that I understand.

I agree. But does anyone know if book publishing and film distribution have the same norms in this respect? (EG. I don't want the OP turning down a deal if it is a norm in film and tv for there to be an upfront payment...)

Zblock,

Sorry, I'm just catching this thread now. I was on Holiday break too and it slipped through the cracks on me.

This is the only one I would be interested in.

However, my concern is that you didn't get as many looks as you could/should have.

email me if you want to discuss unless you have already decided (martin@cinematl.com)

We have a similar deal for our feature Documentary (Beat Makers) which we're very happy with and still collect from after 3+ years.

And you can still sell direct from your website (something we should but don't do) which is ultimate the best profit margin you're going to see.

Again, sorry to be caught sleeping on this thread...I appreciate the love you've given my threads in the past.

Good luck,

Martin

We got two different non exclusive deals, one to put the film in retail stores around the US, the other a 5 year contract with a satellite network, neither asked for a dime up front - we got paid. As another poster said, the ones asking for money up front sound just like the book self publishers, there to take your money and probably not do anything.

Mainstreet -- Are you allowed to talk about any of hte specifics with the retail and satellite?

Either way... this is why I love these forums... just enough people interested in the business side to get some info.
