AVOID user purplebandalero / Michael Owens

Hi Everyone,

Just a warning:

I purchased a tripod from Michael Owens (user purplebandalero) over a month ago. Michael said he would ship it promptly and I paid in full upfront. Unfortunately the tripod never came. Two weeks after placing the order I was finally able to get in contact with him and he said he had been out of the country and that's why the tripod was delayed. Then he promised to ship the tripod the next day.

It has now been 5 weeks since I ordered the tripod and it has not been sent. No tracking number has been sent either.

A suit was filed with PayPal and they ruled in my favor, yet no funds were able to be recovered from Michael Owens' (user purplebandalero) account.

Please note:

Sorry to hear that you can't get a cent back. I hope you do... As for the seller, well, if you check on his history, there have been a few complains from previous buyers. He just takes longer then usually to get it send to you.. As he always claims that he is either out of town or on the road.

I told him once before that if he doesn't have the time to complete the sale, he should not be even putting it on sale in the first place.

Well, people will only have time for the thing that they want to have time for which is to get the money first...

I would suggest a C.O.D when anyone who wants to deal with this guy in future.

I'm sure the U.S post does C.O.D

Ah, and for the record... ( from his older post, he posted his personal details)

His name is James Michael Owens
Address is 2528 Main Street
Dallas, TX 75226

His phone number is 214.884.9226

I have bought stuff from him before- I had to remind him a few times to send it but about 6 weeks later I got it.

I'm not sure why it takes him so long to ship things but you will eventually get the stuff, it just takes a long time.

I met him in person when I bought some computer parts awhile back. He shoots a traveling motorcycle show, and that's his reason for always being out of town, etc.

While I do totally agree that he shouldn't list items for sale if he doesn't have the time to ship them, I don't think anyone has been completely ripped off yet.

You've got his number now... so call him and let him know he either needs to ship the items, or refund your money. Immediately.

Good guy, but VERY inconsiderate seller.

i had similar problem with him some time back.. went as far as filling dispute with paypal... only for me to get tripod 3days after... He's Legit.. just got too much in his plate! Am sure ur tripod will show up soon! with a long explanation.

yeah, i bought an oktava from him and it took him forever to get it to me. claimed to have a motorcycle accident.

i sold him a letus extreme recently, he payed immediately. seemed like a pretty good guy to me. hopefully your situation will be resolved pretty quick here.

I bought a P2 card from him and hes not good at responding or quick to ship but I'm sure you will get your sticks. Just wait it out.

Thank you all for the reassuring news. I do hope it works out...eventually. Anyway I will update this thread with the end result.

I would just like to update everyone. Michael never paid me back or sent the tripod. He sent an email saying he would do one of those after an admin here contacted him but in the end he disappeared with the money.

Beware in the future.

Hope you get it sorted out. I remember him from that one buyer who was out a follow focus for several months from that guy. This should almost be made a sticky or he lose his privilege to post for sale items here in the marketplace.

isn't about time to BAN purplewhateverhisnameis?

this has been going on far too long. he keeps abusing members and keeps getting off scott free..

get rid of him...

Terrible - stuff like this makes it impossible for a genuine newbie here with something to sell - when people mess someone around like that they should be added to a warning thread and if they do it again they should be banned altogether. Sounds like this guy doesn't care.

I'm going to remove my listing for my XHA1 as it's pointless it being there after reading yet another story like this but good luck getting your money back - I'd send a letter to that address you have stating in no uncertain terms that if he doesn't take action within the next 14 days you intend to take legal action...

I have said from the beginning on this site that there needs to be implemented a marketplace user feedback system where transactions and users can be rated.

I've mentioned it multiple times to no avail.

Things like this are going to continue to happen until such a feedback system is implemented.

EVERY other site I go to that has a marketplace has a feedback system.

He ripped you off and you seem to have proof. That is a crime. If you have his contact info, call the police and have them charge him. He committed fraud.

Was this a paypal transaction? If so there is obviously means of contacting him outside of dvxuser. Take action and call the police or something, this it total Bull!@&^. Sorry to hear about this....hope it gets worked out.

yeah, purplebandalero has had SEVERAL complaints here on the market place. and it always seems that he's "out of the country" i dont recall anyone ever NOT getting their product, but it has taken EXTRAORDINARILY long times or the item isnt as described.

i personally vote for him being stickied or simply removed. he doesnt appear to be a criminal per se, but he is giving our marketplace (a place where i have had many happy transactions) a bad name...

First- the buyer didn't 'sue' anyone.
All he did was contact PayPal about the 'dispute' he had- obviously not receiving the item he paid for.
PayPal is NOT anything but a company, with NO TEETH.
It merely tries to settle disputes, and can (if funds are there and accessible) hold money aside until a result is determined.

DO NOT DEPEND UPON THEIR guarantees OF SATISFACTION AND PROTECTION.
There is none, it's all a LIE- - - eBay/PayPal are incapable and ineffective at settling disputes.
If the real world knew how many there are on a daily basis, and how MOST OF THEM go with NO RESOLUTION- they'd find other ways to do deals!!

You do a deal on-line, either here, on eBay or PayPal- it's a CIVIL matter, not CRIMINAL.
Take all your papers to the local cop shop, explain you've been ripped off, prove it even, they'll just shrug their shoulders and say "Get a lawyer."

However, if one could prove a pattern of criminal enterprise (and it's hard to do), then they'll take a hard look at it- even if it means calling in the Feds (FBI or Postal Inspectors).
It is a long, arduously SLOW process- and, in the end, you might end up nowhere anyway (no $$$, no item.)

Second- trying to foist some kind of 'feedback' rating on this informal 'marketplace' is counter to the purpose of it (in the first place).
It is a fraternity of like minded individuals obtaining and releasing film and video gear by merely posting availability or wants here.
99.99% of the deals are straight up and clean.

Sometimes there comes a devious crook, bent on defrauding you in some fashion.
There are telltales that'll warn you (ie; SHOULD warn you) it's a trap (read the stickies here!)
Certain things you do can protect and insure a good transaction.
Common sense is one of them, 'searching' is another- looking at user profile is important.

I'm sorry this seller is ineffectual at following through with his transactions, and- by the looks of it- he should be avoided (as reflected in the title). Only because he can't complete transactions promptly.
I feel for the injured party too- it's BAD to be without the money AND the item. Rotten place to be stuck.

There are ways to obtain satisfaction though.
Posting a negative comment in the Marketplace is not one of them.
(Trying to shame the guy into producing the refund or item is a waste of time really.)
Sure, it helps to warn others- but you're no closer to satisfaction than before you typed the notice.

I would imagine you REALLY want the tripod or the money, right?
PM me and I'll give you a very effective 'hit list' (no pun) on getting that result.
Or not. You decide.

sure it is. people have done it several times before and seems to have helped...

if you have some tried and true method, why wouldnt you post it here so everyone can benefit?
