Question

An example I've seen on DVXuser. Someone made a film and used a lot of Beatles music throughout. Claimed that he could under fair use I believe.

I don't know enough about it myself. Maybe it was because the music is fairly old?

Just wondering really.

Michael, I'm sure this is in Zaza's link, but you should know it was very very cheap for us to license "I put a spell on you" for R.P.D.M. because that recording was NOT one of the famous ones, like Screamin' Jay. So if you want to be safe, it might be worth looking into smaller bands recording the song? We used a recording that a band already had, so I don't know what they paid to record it.

But for us, it was shockingly within reason to go legit with it.

While we're on the topic guys, I think I have a pertinent question. We all know that the a huge percentage of jazz songs have been covers, both for recordings and live performances. I can't even say how many times songs like "Misty" or "Fly Me to the Moon" have been done.

Well, I have some recordings from some nightclub performances of my cousin singing with a jazz trio. I was wondering if I could use one of those recorded songs in a film without any kind of special rights. I wasn't sure if there are unique exceptions because of the cover-themed nature of the jazz genre.
