was I ripped off on this brevis?

and the wrong achromat isnt exactly fedex's fault either...

and if it was shipped in the pelican it came in wouldnt you think the pelican case would be pretty beat up with the kind of damage the unit received?

Yeah, it doesn't change that. In all of the listings it's said as being sold with "hd achromat." I should have taken that as a red flag. I asked him in a pm, is this being sold with "the achromat" and he said yes. But I meant the cinevate achromat. Otherwise I would have asked is it being sold with "an achromat."

Anyway, I'm hoping that this will get resolved. I'll let you know what happens next, until then stay sharp. Even if this does work out I don't think I'll be buying anything used anytime soon unless it's in person.

That does not make total sense. Although shipping could allow some damage to occur, if the package was not properly contained, the fact that the batteries are sitting inside the compartment, free to bump around and scratch the GG, as well as potentially tug lose the wire connections, means that he did a poor job getting the unit to you.

Word is bond. Unless the shipping was so rought that the battery came loose and scrathced the ground glass. I would then expect damage to the carbon fiber tube as well. I mean the Brevis is a very well built device, and I just can't see the batteries becoming "loose". And i'm not indicting the seller, but that would have to be either the roughest treatment of a package or the shoddiest packaging job ever.

We've been shipping worldwide for nearly 2 years now and haven't seen a single instance of the cells coming loose on REV1, or REV2 units. We did have that issue with one of the beta units (and this isn't one of them) but there were only 12 of them...and most have been retrieved/replaced since. That said, we do ship fedex express, and every unit is in a Pelican type box that is also boxed...so extreme shock is somewhat mitigated.

this shipment was not in a box, it was in a Fed Ex Pak, so the only thing providing insulation from shock was the box itself. I noticed that even when closed there was some room for the brevis unit to move around in the case. Maybe this is a consequence of it being equipped with the redrock achromat rather than the cinevate one so the fit is not as snug in the pelican case?

Like I said, I have no idea what happened, but the optimist in me is hoping that this is a case of a problem in the shipping of the unit.

Bad News

Paypal sucks to deal with. End of story.

I got defraud on ebay selling an AIBO. It took almost two months and my dads help (who is a corporate lawyer) to recover the funds. The bad news is the amount of time you will have to spend to get the funds back (if you so choose).

Good News (if you want your money back)

The good news is Paypal favors the buyer. Paypal will freeze the amount to which you paid for the item in the sellers account when you file a claim. If the seller refuses to take the item back, escalate the claim as soon as possible. Trust me, the first part of the resolution process is a waste of time if the seller won't except the item back. Your next step is to escalate the claim. It will take about a month to hear back from Paypal.

You are heading in the right direction by having Fedex inspect the package. Paypal will ask you to fax them the Fedex report once they review your case. Paypal will treat the Fedex report like a police report. If the Fedex inspector determines that it was their fault (good luck), then seller will be "made whole" (provided that the package is insured for the correct amount). Paypal will then rule in your favor of you and put the money back into your account.

I am almost positive this scenario won't happen, unless your package looks like it was run over by the Fedex truck.

Paypal will then give you the option to send the package back to the seller in the original condition. Paypal will ask for the tracking number. Once they verify that the package has been shipped they will rule in your favor and return the funds to your account. The seller will then probably say that the item is not in it's original condition. Paypal will still rule in favor of the buyer because it is now "he said she said" and Paypal always favors the buyer (I know this all too well) unless there is overwhelming evidence that you broke the unit.

I would also file a report here http://www.ic3.gov/ . Paypal will probably ask you to do it anyways.

I hope this helps. Good luck.

Thanks Richard.

When I contacted paypal I got this response:
"As stated in our User Agreement, the claims process only applies to the shipment of goods. It does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a
refund."

In case it is the seller's fault do you know if there's a way around this?

You might have to suck it up man. I mean not to bag on you but it happen to me too...and it was a whole lot more than the cost of a used Brevis...I mean a WHOLE lot more (try 4 wheels). Get it refurbed and get to shooting. Nobody...and I mean Nobody has the turn-a-round of that Dennis guy. He's a good dude.

FedEx paid the shipper $100 (their maximum liability) and $25 to refund the cost of shipping. The seller forwarded me this cash saying that since I did not give him any money for insurance that he will not pay me anything extra to get the brevis into the condition which he advertised it as being in when he sold it to me.

I am unsure what to make of this. I sent him $40 for shipping. The extra was to cover the other expenses (tax, insurance). I don't know what he did with that money.

At this point if it were me I'd just pay to have Dennis fix it up right and consider the seller a worthless piece of crap. Please do let us know who it is as I definitely never want to do business with this seller.

I just pm'ed Dennis to make sure the offer for fixing it still stands. From all my contact with the seller he does not seem like a bad guy. Yes, he has taken much longer in getting back to me on average than I would have liked. And yes, I feel this process has become much longer and more drawn out than it should have. But up until today I had always assumed he'd do the right thing and reimburse me for the cost of getting the unit into a usable condition.

The kicker is that he accused me of trying to extort him when I asked him to cover the shipping and handling cost for getting the fixed unit shipped back to me from Cinevate. I left him a couple voicemails and e-mailed him. If he doesn't get back to me today I'll release his name. Like I said at the beginning of the thread, I would do so if it turns out i was getting ripped off in some way.

I'd like the name of anyone that thinks tossing an adapter in a box is considered shipping. There wouldnt be any of this damage if he shipped it properly.

As I don't want to be accused of falsely representing anyone. Here is the message he sent me today. As I mentioned he claims that I requested not to get any insurance and only sent him enough to cover shipping. Even though I have paypal records that show I sent $40 for shipping (it costs about $27), more than enough to cover 2day from SoCal to NYC and insurance.

And, as I noted in my previous post, he takes issue with the fact that I wanted him to cover the cost of me shipping to Cinevate and the charges Cinevate would bill me for having them ship it back to me.

its his fault for not ensuring insurance was placed on it. As far as I am concerned the seller is totally responsible in this case and acting extremely unprofessional.

that is some BS, whats his name? stop the madness already

No ****. I have a couple PMs to people about buying items and I don't want to get scammed. And this is BS afaic

"I placed insurance on it to be safe, but the lady at the place did not enter it in"

That's a crock. What FedEx fills in the forms for you? I pick up a form, fill in the "to" address, the "from" addres, whether or not it's residential or commercial, what's in the package and the insurance information before then signing the sheet. The only thing the FedEx employee enters is the measurements, weight and cost to ship. If he actually placed insurance on it, he'd have a receipt showing that fact. I call bullshit.

Case (hopefully) closed: After contacting the seller again and explaining to him everything I've told you guys he agreed to give me another $95. That brings the total to $220 (it costs $200 to fix the unit). That won't cover all the shipping and hanlding to and from Cinevate. But it's better than before. Dennis, does that generous offer to fix this poor, abused brevis still stand? If you're still wary and want to know who he is PM me. Would I do business online with him again? I really don't feel like doing business online with anyone anymore. I don't think he's a scammer. But this whole process has been a pain.
