Death Cab For Cutie Music Video

A couple of friends just felt like making a music video, so they created a script and found me because I had the camera.

The 1st shoot that we did, I just got the camera a week before, so I didn't know about the white balance button, and I forgot to put color correction on it in post, so the start, and the parts where they are in front of the tree, have very dull color. The part that came out the best is at 2:16. It was getting dark out, and the white balance made it look great, plus the "basic" filter on Magic Bullet really brings the color out.

So who owns the rights to that song, you or your friends? Or did you get clearance to use the song? I see at the end you named the record label.... but technically, you'd still need clearance to ever use it.

We put the rights to Barsuk Records on both the beginning and the end.

So would that mean, I just need to name the record label at the beginning and end of a feature film to use a song from say "Hawthorne Heights"?

What is wrong with it? I'm not selling it or anything. It's not right to make a fan music video? Look up a music video for any band and you will find MANY fan made music videos.

Yeah you just didn't say it at the beginning..

Anyways.. the video was ok. Not spectacular.. the look of it could've been a bit more exciting I guess. Like with color correcting etc.

and they are all copyright violations. reuse is reuse is reuse. no cares whether or not you sold it.

It's just at the school I went to, we had to clear everything we didn't have copyright ownership to ourselves. Music, video clips, ect. If you had a band and wanted to use your own music that was fine, but even if you wanted to use a friends music you had to have a written contract with them saying so. And this was a high school..... so it obviously wasn't going to be making any money.

But anyway, it's still a nice video..... atleast you're shooting something, unlike me.... lol.

Of course the correct thing to do is having rights to use a song, but I usually say as long as your not making any kind of money(and do think this one through as if in any way the usage of the song leads to you making money, you could be in danger). Therefore I would always ask for premission to use a song if I were to send the video in for some kind of festival, even if there is no money to gain of it.
But for small clips here on the internet just to show some people what you shot yesterday it feels safe to use it(even if it's illegal), just look at youtube, would be kinda distressing for the music labels suing all of those non-rich people just because they used one of their songs in a video they filmed of their dog doing backflips.
I'm not encouraging anything, you must have permission to use anything that's copyrighted, but you know it's like...ugh. :)

ya you might want to edit your thread title to say "fan video" or something.

this could give people the wrong impression.

and don't worry, death cab isn't going to hunt you down and sue you for making a fan video. That would be even dumber than Metallica suing every person who downloaded their music off Napster. Talk about a public relations nightmare....

Video doesn't work...I just get a white image. I tried downloading a codec but I couldn't see it still!

You tube version...Here I come...Sigh

(Don't tell people!)

Here's a good link that explains the basics:
http://www.templetons.com/brad/copymyths.html

A small quote: "It's still a violation if you give it away -- and there can still be serious damages if you hurt the commercial value of the property."

By "hurting the commercial value", they could mean several things. First, if you gave away a bunch of copies and everyone hated the video, it could be argued that you have de-valued the band's image and potential sales. Lawyers will try every angle. This is not a comment on your video - I haven't watched it yet. I just like talking about Copyright law because it interests me. Second, for every copy of the video you "give away", you must realize you are giving away a copy of their song too.

Now, I'm not saying you'll ever get into a lawsuit by doing what you did. I doubt the record label would take any action unless you portrayed this video as "official" in any way. But it IS good to know everything you can about the laws :)
