Don't you only need to change a patent by 10% to make it null and void? Just because a patent is issued dosen't mean that it can't be challenged and beatin in court. During the Internet hay day the patent office was granting all kinds of patents on Internet technology that 95% of them would be beatin if challenged in court today.

I'm no lawyer, but I believe there are different type of patents. There are design patents, which are easier to get. you are protecting the image and manifestation of your idea. (so you cannot patent the idea of a chair, but you can the way the chair is created, size, shape, etc....)

Then there are functional patents. where you patent the function of something. These patents are much harder to acquire since they will be limiting other people from creating something with the same function as your patent unless you license your patent to them.

And I believe there are other patents as well that protect the procedure in which you do certain things?

I believe if Juan filed for a patent, it would be for the function or the procedure patent. Meaning, he has figured out how to tap into the ccd's and has found or created software that interprets that information into an image form. And that if you want to do the same thing in the same way he did, you would have to license it from him. (now if you were to tap into the ccd's in a different way, and put that information into an image in a different way that he did, then you would be ok) But I don't think 10% alteration will hold up in court regarding a functional or procedural patent.

Please, any lawyers out there with better information feel free to correct me, and or clarify. (my knowledge of patents is limited) :)

As far as I understand it, the only way to challenge a patent is to prove that the "invention" is obvious and therefore not patentable or, failing that, to prove the existence of prior art. You'd probably have a hard time proving Andromeda obvious. But sure, if you have a ton of money, you could fight the patent in court. My guess is that the buyer of Andromeda/Hydra has more money and better lawyers.
 
If red did buy the technology, They would probobly not implement it in an hvx. It would probobly be in a new cam they create. Also it seems that the place Juan works and the company that bought bought are two different things, but wherever Juan works he has the rights to use the technology because he obviously made it.
 
The end product may be different from HD-SDI out, but the concept isn't, right? It's a method to get a signal out of a camera. What it carries over that signal can't be patented, right?

I don't know how one would prove a percentage, but I DO know there are people who have made fortunes by reviewing valid, existing patents and their relative drawings, figuring out ways to improve them, then patenting and marketing the improved product/process. There are people known for doing this; one guy in particular is known for it (can't recall his name) who, I believe, holds the record for doing it into double-digit figures. He's made a fortune improving things, including the likes of office machines, e.g. copiers, etc. made by some very big companies.

How many times have you bought something to find it only did 75-90% of what it was capable of or what you wanted it to do? He makes (made?) the effort to get a product to do more, or do it better/differently. (I read about him approx 10 yrs ago, and he was up there in age then...maybe early-to-mid-70s...not sure; he may have retired or even passed away by now, but he was known for starting new companies, selling them or licensing the technology, then moving-on to a new project).

So, unless those aspects of patent law have changed so drastically, anyone savvy, gutsy, and knowledgeable enough, could pursue it.

Lastly, as I understand it, you can replicate a patented product or process as long as you don't try to profit from it, i.e. for your own use. So, you can work on this in your basement/garage, but, if successful, don't charge for it or advertise that you can do it. You could be the only kid on your block with your new toy.

In an earlier post Tzedekh posted a link to the patent application for Andromeda ( patent ). I have searched for the Hydra patent application with no luck. Does anyone know for sure if Juan has filed for a patent or how to find it? Patent's tell you how things work and I'd like to see the details...

Mike seems pretty tight with Red, so perhaps they don't have anything to do with the sale OR Juan's new job.

Singed!!!! I know, from all people :) in this thread who speak very highly of Juan, count me in! For the record I DO know Juan worked his A#S off on this project and yes I'm upset I might not get the chance to experience it... I undestand the "rumors" but communication is key!

If I had to guess which company bought it I would say Zacuto.
Oh, and I won't say, "I told ya", because I knew it already. I was just wondering how long would it take for somebody to spill the beans but I didn't want it to be me. I wanted to give Juan the chance to tell himself. But I knew soon or later somebody else would let the cat out of the bag if Juan took too long.
I wish somebody had taken my HVX bet though. :D
 
Signed. What a bummer. I've been watching this thread since page one, and have been developing a project for Hydra use, too. I'm hoping the petition works out, because the technology would really be missed.
