i was in a car accident

Looking for a woman
we were hit by an suv. thankfully, my family and i didn't suffer any serious injuries, but we had to spend the day at the hospital because my wife is pregnant and they had to monitor the baby.

anyways, the guy that hit us doesn't have any insurance and was driving around with expired tags. i'm sure we'll be covered with an uninsured motorist claim, but what if it doesn't pay for everything? will i have to sue him for damages or does the insurance company handle that sort of thing?

has anyone been in a similar situation or have any advice?
 
I hope for your sake your policy is different, but I know on my insurance, "uninsured motorist" coverage only covers medical expenses related to injuries sustained by those in your vehicle. It does not cover any damage to the vehicle itself.

Did you get a police report filed, I hope? If so, a civil suit will likely be easier.

How bad were the damages? Was the vehicle drivable afterwards, or did you have to have it towed?

fortunately my plan covers the cost of the vehicle also. my car was totaled.
 
Glad to hear that you and your family are okay uga. Good luck with the insurance, do you have comprehensive cover?
 
So your covered on the insurance and everyone is ok? Hopefully they dont screw you out of the value of your car. :-/
 
Was the other guy an illegal? If so, you can forget about collecting a penny. Happened to my cousin 6 months ago, and my mother-in-law a year ago.

being as he didn't have any insurance and had expired tags, he was driving illegally. when we left in the ambulance he was still with the police. one of the officers came to the ER and said the guy was going to have to go to court, but i didn't ask if they arrested him there.

I'm certain that you're all shaken up - but thank god you and your wife were able to walk away unharmed.

I'm pretty certain it all depends on the specifics of your company/policy.
My wife was once hit by an uninsured motorist - her car was totalled.
It was all covered by her insurance, and her insurance company then sued the uninsured driver.
I have no idea if they ever got any money out of him or not.
 
Man, threads with titles like this scare me, though generally they mean that everyone made it ok to be able to post. :)

The insurance will not sue on your behalf for what is not covered. You can count on them suing him for what they pay you. You can still sue him for anything not covered under the insurance.

Am I the only one who finds this backwards? The guy that DOESN'T have or pay for insurance causes trouble for the one who does? I know thats how it goes but it bugs me. I hope things work out for you.
