2) One of my friends had an awful time getting paid from one guy. So he called up a Hell's Angel and said "can you please just stop by so-and-so's place and ask him to finally pay?" It worked, the guy paid... although I'm not sure whether the biker ever gave Pat the money or not!

How was the agreement for the work decided? Is there any paperwork at all on the description of the work, hourly rate, or final fee? Evidence of contractual agreement is a must. The bounced checks will be of some assistance.

First send a letter of demand which should contain all the necessary particulars and date on which the payment should be made. After that it is a choice of taking him to small claims (or equivalent where you are) and hope the dog turns up. For a couple of grand, legal fees will eat that if you go down that path. Your friends might have to call it a day and learn from the experience.

Apply the same principles to this work as any other. Example:
  • Always get a contract.
  • For work over over $500 have the contract dictate a non-refundable percentage up front. This prevents people backing out and covers your costs (this is essential for work over $2000)
  • Define copyright and licensing in the contract.
  • Use the contract to define as much of the work as possible to make it binding.
  • Have the contract define delivery of the final product which makes it difficult for a client to simply 'back out' of the deal without paying.
  • Oh yeah...get that contract ;)
I've been self employed for while and had to go down the path of clients defaulting. It isn't pretty, but the best thing is to do all your preparation, don't go in half arsed. There are a number of boilerplate contracts sitting on the web someplace. I have a few, but they are of course only legal in Australian.

Remember, a contract is only as good as the laws in your State and country. Know your rights. Protect your livlihood.
