Showing Movie Posters In Background of A Short Film

If I wanted a couple movie posters on the wall of a scene for a short, then submit that short to a film festival, is having said posters in the background a copyright infringement?

It's illegal, simple as that. Recently we used some generic posters for our movie. We're sure they're just as illegal, but we figure people won't mind us using a drawing of a dragon and a picture of a moon. But yes, illegal. You should technically make your own, we just didn't have time.

Are you absolutely sure it's illegal? If it's not being missued there may not be a real issue unless it's disney.

Whether it is or not, you (The OP) might want to try and hit up some DVXusers to use their posters in your background. I'm sure they would not mind the extra exposure and you would not have to deal with the possible problems of someone who decided to make it an issue.

I could get you our movie poster for your film, if interested. Pic

This my design, so I'll have a lot of say on it's use.

No strings attached. Well, other than a frame pic of it being used of course. LOL The original is 24" x 36" and at 150 dpi

Thanks for all the info. The shoot is tomorrow though. I had a couple posters I was gonna use but wanted to check with the experienced members of dvxuser first ;)

Wow, that's seems to be the nature of "Indie's". Critical set design questions waiting to the last hour.

Not trying to be harsh, but that should of been a question asked at least a few weeks ago.

use of any "art" is usually not legal to use without permission, which has included in the past movie posters, paintings, statues, album covers, collages hanging over cribs. You usually need to clear those things although there is some case law where there is a little wiggle room in limited circumstances.

(THIS DOES NOT MEAN YOU NEED TO CLEAR TRADEMARKS IF YOU ARE USING A PRODUCT FOR ITS INTENDED PURPOSE)
