Need Landlord Help: Toilet explodes when it rains! He does nothing.

Happens here all the time but my girl is relentless and they just can't seem to beat her and yes, we have been a few months late on rent also. Doesn't make a difference but they will try to throw that in your face. You just say, its not as late as you fixing the fooking pipes.

You can also get the Tenants Rights guide from the Attorney General's office.

... Its going to require yelling matches and threats from both you and your landlord but you have to keep the upper hand on them and know your sh1t before going to war....

Most Interesting Advice award goes to you, Beat. Congrats!

It's because he's a native Brooklynite and knows that's how they roll here. It's almost a negotiating game where they expect that. If you don't go to that level, they don't see a need to take you seriously till you do. It's just phase 1 vs. 2 vs. 3, etc.

:Drogar-Smoke(DBG):

We go through it all the time. Its not just complaining to them about the problem, its about having the ammunition to counter anything they throw at you to keep you quiet. They try to intimidate all the female lease holders here but they get the biggest surprise when try. Sometimes the other neighbors will come out and band together if the yelling gets too intense. Most of the time its not even the owner of the building, cause its managed by a company so you deal with some pee-on from there and its usually a big guy that tries to look and act like hes down with the mob or something.

I'm glad we have law and order in LA. (At least with regards to situations like this.)

It's so much more efficient.

NY sounds like fun, though. Do you guys strap on six-shooters? Or is it glove-slaps and duels?

Like they say... got to keep your pimp hand strong

Ok. Rained. Happened again.

Pathetically we tried to duct tape and cover the toilet when it began raining. Didn't work.

Short term: We've called a professional cleaning service. We haven't paid rent yet (not late, due by the 10th). So we will pay the cleaners with part or all of the rent money and either ....

A) Send the a copy of the receipt and what's left over for rent to our landlord.
B) Send a copy of the receipt to the land lord and put the remainder of this month's rent in escrow. We will continue to pay rent for 3 months into the escrow account. If the problem is not fixed by the end of the three months, we will stay for a 4th refusing to pay rent and use the 4 months rent as first, last, deposit, and moving truck to get into a new place. If the problem gets fixed - really fixed, then we give him the money in the escrow account.

We'll probably do "B" but it's a scary move for us. He can mess up our references, credit etc.

But please tell me you got video.

What is your long term plan? Did you get an attorney? Did you contact building and safety?

Jack, if you would like, I will fly out there and help you take care of this. No one can resist the power of the Penguin.

Best of luck, buddy!

yeah we got video

long term we are looking into free advocate services - zero money for an attorney
and as alluded to we will send a letter stating that we are putting rent into escrow for a period of 3 months and if the problem is not fixed we'll have enough money set aside to move.

Professional cleaning (that we are paying for at the moment) is here.

This is gratifying in two ways:
1) The $375 we are paying him is $375 our land lord is not getting this month.
2) He's writing on the reciept that it's "category 3" water damage "raw sewage". "2" is natural water - rain leaks. "1" is clean water from plumbing. But anyway having it documented by a third party that it is real and the worst kind is good.
