Need Landlord Help: Toilet explodes when it rains! He does nothing.

There is another health hazard besides the crap, is that that cabinet is probably molding behind the kick panel. or anything else the water can get behind. You might want to check that out and try to get him to replace the cabinet.

in all honesty i have no idea how you've put up with this for so long. the first time this happened i would have been pounding down the landlords door about the crap volcano in my apartment. let's see if the DEP reps actually come out to inspect it.

and i'm sure you know this already, but any girlfriend that stays with you despite a geyser of raw sewage erupting every time it rains is a keeper.

AND she has a sense of humor about it. I've been with some cool broads in my day but even the coolest of them would be on my case, hard, to get this taken care of.

i said "cool broads".

Note to Self: Examine reasons you might be single.

Well we got the place together and she's as broke as me (mostly because of me) but she's stuck here like I am.

But I put her through all sorts of metaphorical sewage that makes her a keeper anyway. :)

Yeah I'm gonna look for those DEP guys.

it's kind of OUR problem, and our frustration level and ideas about what to do about it are equal ... so every time it happens we're like ... ok what now ? ok let's try that. kind of thing.

Plus as a small child she spent most of her early life touring America in a motorcycle side car with her father who was a professional square dance caller, staying at camp grounds and eating a lot of McDonald's. (true story) So she's pretty tough, and has a high tolerance for us creative types.

Wow thats awful...

Yea call 311, but this time ask to be put through to a supervisor. and ask them exactly which department to talk to directly.

While I never would have exactly guessed that, that is just about the ballpark I would figure for a JDS GF.

Jack, yeah, that sucks. On a somewhat related not this happened to my buddy during the past winter - (I posted this up a while back)

My friend in Halifax sent me this earlier this week. The end of last week there was pretty mild temperatures and rain which basically melted all of the snow, this caused the storm sewers to back up and flood the street about 3-4 feet high outside of his apartment building. Then what we have dubbed "The shi*flood" happened, his underground parking garage was flooded. Besides that being a problem, in some of the older parts of the city the storm sewers and septic system are one so his parking garage was flooded with raw sewage, some parts of the garage were flooded about 8 feet high. He sent me some pics. You can see the residue line of how high it got up to on his car and there still some sewage in the inside. There were 35 cars in the garage that are writeoffs, his included. He said it was one of the most disgusting smells ever. Insurance will cover it though so all is good.

And what's even crazier is that about a month later it happened again, this is after Insurance covered the cost of the car and he bought a new jeep which was parked in the same place. He woke up early one Saturday morning and noticed the street was flooded so he decided to check on the his jeep, the water/sewage was half way up the tires and he had enough time to get it out of the garage before it was ruined, but a lot more cars got ruined again. They finally had enough and just moved out.

Wow that sucks, as a former GTI owner seeing that VW like that is horrible... luckily he got the jeep out in time.

When I read the subject line I assumed this was a joke... man... that's horrible, Jack... but in the meantime I think I have your new avatar. I wouldn't want to be there when the sh*t hits the fanny.

Wonder if your building's sewer lines are connected to the city drainage system instead of the sewer. I could imagine the EPA getting your landlords attention.

This is a major health code violation here, it's just not right...

(1) Contact the city health department.

(2) Contact the major TV and print news media. You video will be great for the nightly news and will put pressure on the owner.

(3) Get a good lawyer; he can tell you what rights you have.

(4) Be sure to give us updates on how this works out.

Hmmm ... that's a good angle as well.

So the way this goes, or has gone, we will ask what action is being taken based on the DEP. They will tell us something. And then we won't know again until it rains.

I'm gonna try to verify that the DEP people were really here somehow and if they were then we're gonna give it one more try - see what happens next rain, and then we will hit them with everything in this thread I think.

Or landlord is scary. You just don't want to be negotiating against him or battling him if possible. Not from a break your legs standpoint or anything, but the way this guy is we could wind up going to court and paying him for claiming he had emotional trauma brought on by our repeated complaints, that kind of super slippery scary.

Thanks for the advice and commiseratory humor.

I'm just catching up on all the poop now. :)

Man, just horrible.

I have a similar situation at my apartment. The tree's roots in the front yard are blocking the flow of the sewage pipes. So ever once in a great while, the blockage decides to reverse direction. There's nothing like seeing sewage rise from the toilet and bathtub drain on an early morn, I tell ya.

Basically, the pipes need to be replaced and rerouted. It is about a $3k job, according to Roto-Rooter. The landlord doesn't want to bother doing it (even though he is a plumber with his own plumbing company). So his solution is to manually clean the pipes every so often. It just concerns me greatly that the situation may "explode" again before the pipes get a good cleansing.

If he needs new sewer lines it could be a lot higher then 3k, we spent 12k a few years ago at my grandmas house for a new sewer line from the house to street... Same deal tree roots clogging the pipes... But then again we paid more so they didn't have to dig the garden up, they pulled the new pipe in with a winch.

You have to find out of the building has a tenant association and see what DHCR complaints have been filed. Its almost impossible to get anywhere without a lawyer though. When the workers come you have to DEMAND to see that they are certified to do the work because most of the time they are just immigrants that don't know crap. They tried to do that here but no one would let them in the apt. until they saw proof. We do the same. You also have to do the research on how the problem should be fixed so when they come you know they are doing the right thing. Sometimes they try to do a quick fix but you have to stop it and say no, do it right and this is the way its done. Its going to require yelling matches and threats from both you and your landlord but you have to keep the upper hand on them and know your sh1t before going to war. I would go into more detail but keeping things like this as quiet as possible keeps the landlords guessing.
