Mind Your Business: You will lose ALL the Rights to your own Art

Just saw a post about that on cgtalk.com, and thought it would interest a lot of people here too.

With so much focus on Hollywood's plight over the issue of piracy, it's disturbing to know that the intellectual property rights of artists are being attacked.

I encourage all artists to read this article, and pass it along to your colleagues!

This is insane!

One of the most sickening things about that article is that Corbis is a company owned by Bill Gates... and that is one of the major proponents of this legislation. EVERY TIME I try to update windows it's got to run a complete piracy check for "Genuine Advantage Validation" of my XP Pro... and it does this EVERY TIME. There is so much about piracy from Microsoft, a company FOUNDED on piracy... and now this? Flat out STEAL any cool images that you stumble across on the internet, so that you can claim ownership and then force others to pay for any use of the image that you stole???

This is the most crazy thing I've ever read. I hope everybody is paying attention... if you're on this board then this concerns YOU.

In the interest of everyone understanding the situation, here's the proposed bill (which hasn't gone anywhere for two years):

It's usually a good idea to go to primary sources. Blogs are fun reads, but not good places for reliable information.

If things were as the article suggests, then yeah, everyone should be steamed. But researching this independently, I don't think it quite matches up to the picture the article paints.

My impression was it seemed like a rant based on the author's perception of the proposed law. I was going to say I'd like to see the actual bill, and here it is. This legal stuff is still a little hard to grasp but glad it's here to read.

The only way I'd take a copy of Vista would be to burn it, deeply inhale the fumes, and hope I'd get a hallucinogenic buzz off the fumes.

REASONABLE COMPENSATION.—In establishing
reasonable compensation under paragraph
(1) or (2), the owner of the infringed copyright has
the burden of establishing the amount on which a
reasonable willing buyer and a reasonable willing
seller in the positions of the owner and the infringer
would have agreed with respect to the infringing use
of the work immediately before the infringement
began.

That part bothers me.

I take to mean what would have been charged under normal circumstances.
Sigh, now that's another story.
