If only the tenant signs the location release

and not the actual owner of a home, am I playing with fire?

I am not concerned at all with the actual shoot beause it is a 3 person crew so noone would even know it was happening. I am talking about if the owner sees the video a year later and tries to sue me because I did not get a release from him.

I would have a release from the legal tenant of the property though.

Your thoughts?

You need permission from tennant and home owner for it to stand up. If it's just a little short film that won't see the light of day I wouldn't be worried though.

Legally you need permission from the OWNER. But, like most people have said, chances are nothing will happen. Just be aware that you don't legally have permission.

Yeah, I can see why he wouldn't want to contact the owner. What if he/she said no?

That's one location down the drain...

The owner - tenant thing can be sticky. Most commercial leases will either specifically define permitted usage or state "any legal purpose" which would include making a movie - provided the movie's not illegal itself. A residential lease could be as broad as "any legal purpose" and would generally be construed to be unless more restrictive language is specifically included in the lease.

All that being said, any argument about this will generally involve a lawyer - much easier/cheaper to just get both signatures ahead of time whenever feasible.

We had a problem with this stuff, and ended up altering the background in post...no one recognized it as the actual locaton after that.
