Ohio Judge: Solicit Prosititutes, Wear a Chicken Suit

Heh Im not sure of it either way. But the judge would be operating within the law. Ive always thought of criminal sentencing as 2 parts punishment and 1 part detterent. SO if people are starting to think - **** I dont want to be in the newspaper in a chicken suit - Ill stop and think before I do that - well its working on at least one level.

As you correctly point the outside looking in cliche, I will expand on that and say that if a criminal had done something to a relative or friend of mine, no I wouldn't give him any rights.

There you go, but the point is that we need to treat criminals fairly even when we're the victim. Adopting an eye-for-an-eye attitude can come back to bite you in the butt later if you do something wrong and no one will stand up for your rights.

And as to whether a criminal can be instructed, I believe they can, I just don't know how. I personally believe that prison time is only a stop-gap measure and that rehabilitation is a much more complex process than simply locking someone up or humiliating them as this judge did.

... on a side note, and unrelated to your initial post...i don't think the judge is making these sentences just because he has a sense of humor. i believe he is making a statement about our common methods of punishment and the need to reform our penal system.

Really? Any guesses as to what it might be? Really asking, not attempting to be argumentative ... I'm curious.

Surely he's not saying that we should go back to Scarlett Letters and Stockades ... or is he?

What is the limit or check on what a Judge can sentence? I mean it sounds like a judge could sentence me to wear a large marble in my shoe for the rest of my life if he thought it fit the crime ... or to spend a day in the stockades, or to tattoo the word "Rapist" on my forehead ... really?

or to tattoo the word "Rapist" on my forehead ... really?

Now that I wouldnt have a problem with - EXCEPT, sometimes they get it wrong - "an innocent man is now having the "rapist" tattoo removed from his head, the process takes about a year, until then he will be playing Nintendo Wii, provided by the state penal system"

sentences usually fall under these categories
1. fine
2. community service
3. probation
4. prison

i think he is saying that we need to explore new solutions that more appropriately relate to the crime. someone in prison for drug possession is serving the same punishment as a murderer. only his length of stay is shorter. perhaps we as a society need to take reevaluate these categories and think of more creative ways to handle criminals.

of course, maybe he's not saying any of that and just likes criminals in costumes. :D

Hope the guy doesn't have any kids or a partner.

Publishing the perp's name to humiliate them is sure to do much more damage on their families then on the perp themselves.

A judge should have no rights to "create" a punishment. Sentencing shouldn't have gray areas. If person is guilty of A he/she should serve B as the sentence. period.
Too many judges pass judgement based on personal feelings and that is absolutely wrong.

As for humiliation, if terrorist suspects were dressed up in chicken suites I'd put money on it people would be coming out of the wood work screaming unfair treatment.

True, but that doesn't mean it's right. The ACLU would probably protest, but not many people would listen. That's the way it works. We care more for our own than what happen to a stranger.
